A proceeding occurred on March 29, 2011 on Equitable Distributioon which was premature as there were a number of related outstanding unresolved issues before the Court. During this proceeding, the Defendant was prevented from presenting any evidence or exhibits relating to the outstanding petitions.

The Honorable Judge Carolyn Carluccio repeatedly dismissed any testimony relating to the outstanding petitions and repeatedly indicated that hearings would take place for the petitions which were incorrectly cancelled just prior to the March 29, 2011 proceeding.

During the March 29, 2011 proceeding, the Honorable Judge Carolyn Carlucci scheduled the incorrectly cancelled hearings on the outstanding petitions for May 5, 2011.

Those hearings were again subsequently cancelled creating confusion for the Plaintiff and Defendant who were both left unsure if the hearings scheduled for May 5, 2011 were cancelled.

Defendant respectfully requests that proceedings be scheduled for the above listed petitions.
